Introduction

These are the general terms and conditions of TLC Holland B.V. (hereinafter: Truckjunkie). These terms apply when you place an order through our website and contain important information for you as a customer. Please read them carefully. We recommend that you save or print these terms so you can consult them later. After reading, if you have any questions, feel free to contact us using the contact details listed on the website.

Article 1 – Definitions

• Truckjunkie: TLC Holland B.V., with its registered office at Leije 16, 5422 VB Gemert, registered with the Dutch Chamber of Commerce under number 92797202.
• Website: truckjunkie.nl and all related subdomains.
• Customer: any natural or legal person who enters into an agreement with Truckjunkie.
• Consumer: the customer who is a natural person acting for purposes outside his or her trade, business, craft, or profession.
• Agreement: any agreement between Truckjunkie and the customer to which these terms and conditions apply.

Article 2 – Applicability

These terms apply to all offers, orders, and agreements of Truckjunkie, unless agreed otherwise in writing. Deviating terms of the customer are valid only if they have been confirmed in writing by Truckjunkie. If, in addition to these terms, supplementary terms apply, the consumer may, in case of inconsistencies, rely on the provision that is most favourable to them.

Article 3 – Prices and Information

All prices on the website include VAT and—unless stated otherwise—exclude shipping costs. Any additional costs will always be clearly stated in advance. Truckjunkie takes great care to provide accurate information on the website. Obvious typing or programming errors do not bind us. Colour deviations may occur due to screen settings and do not constitute errors on the part of Truckjunkie.

Article 4 – Formation of the Agreement

The agreement is concluded as soon as the customer has accepted Truckjunkie’s offer and has met the stipulated conditions. After an order is placed via the website, the customer receives an electronic confirmation. As long as this has not been received, the consumer may rescind the agreement. If incorrect information has been provided, Truckjunkie may postpone performance until the correct information is received. Truckjunkie reserves the right to refuse orders or to attach conditions—such as advance payment—if there are legitimate reasons to do so.

Article 5 – Delivery and Performance

Truckjunkie dispatches orders as soon as possible and no later than within 30 days, unless otherwise agreed. If delivery does not take place within the agreed term, the consumer may rescind the agreement. The risk in the products passes to the customer once the products have been delivered or collected. If a product is not available, Truckjunkie may deliver a substitute product of comparable quality. The consumer may return this substitute product at no cost.

Article 6 – Right of Withdrawal (Consumers only)

Consumers have the right to withdraw from the agreement within 14 days without giving any reason.

• Period: 14 days from the day the consumer has received the product (or the last product in a single order).
• Notice: withdrawal can be notified by post or email to:

• Return: products must be returned within 14 days after giving notice of withdrawal. Return shipping costs are borne by the consumer.
• Refund: within 14 days of withdrawal (or upon proof of return shipment), the consumer will receive a refund of all payments, including standard shipping costs.
• Exceptions (no right of withdrawal for, among others): products that cannot be returned for hygiene reasons and whose seal has been broken; custom-made or personalised products (e.g., printed textiles); perishable goods; newspapers, periodicals, or magazines (except for subscriptions). The model withdrawal form is included under Article 13.

Article 7 – Payment

Payment is made via the payment methods offered during the ordering process. If payment after delivery has been agreed, a payment term of 14 days applies. In case of late payment, statutory interest and collection costs will be charged.

Article 8 – Warranty and Conformity

Truckjunkie warrants that the products comply with the agreement and with legal requirements. Any defects must be reported as soon as possible. In the event of a justified complaint, Truckjunkie will repair, replace, or refund the product. This does not affect consumers’ statutory rights.

Article 9 – Complaints Procedure

Complaints may be submitted to Truckjunkie in writing or by email. The customer will receive a response within 14 days. If more time is needed, the customer will receive an indication of the timeframe. Consumers within the EU may also submit their complaint via the European ODR platform:

Article 10 – Liability

Truckjunkie’s liability towards business customers is limited to the invoice amount (maximum €200). Indirect damages (e.g., consequential loss, loss of profit) are excluded. These limitations do not apply in cases of intent, gross negligence, or personal injury.

Article 11 – Retention of Title

All delivered products remain the property of Truckjunkie until full payment has been received.

Article 12 – Governing Law and Disputes

All agreements are governed by Dutch law. Disputes will be submitted to the competent court in the district where Truckjunkie has its registered office. If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.
